Provider Terms and Conditions – TravelAndRent

These Provider Terms and Conditions (hereinafter, the "Terms") govern the access and use of the platform TravelAndRent, accessible at www.travelandrent.com, owned by Pacific Board SL, CIF B16674541, with registered address at Roger de Llúria, 90, Barcelona, Spain.

By creating an account and checking the box accepting these Terms, the provider agrees to comply with all provisions described herein.

1. Purpose of the Platform

TravelAndRent is an online aggregator platform that allows rental businesses (the “Providers”) to showcase their rental products and receive booking requests from end customers (the “Customers”).

TravelAndRent acts only as a technical intermediary and does not participate in the commercial or contractual relationship between Providers and Customers.

2. Provider Account and Access

  • Providers must register and create an account with a username and password.
  • Each new Provider account must be manually reviewed and approved by TravelAndRent.
  • Providers are solely responsible for all activity performed under their account.

3. Content Management

Providers may upload and manage content including:

  • Product descriptions, prices, specifications, and availability.
  • Photos of bicycles or rental products.
  • Contact details, links to their website, and business information.

Providers agree to:

  • Ensure that all published content is accurate, truthful, and up to date.
  • Avoid content that is offensive, illegal, misleading, or contains watermarks, advertising, or third-party intellectual property.
  • Not create multiple accounts for the same business unless expressly authorized by TravelAndRent.

4. Booking Requests

  • Customers submit booking requests via a form linked to each Provider’s product page.
  • Requests are delivered to the Provider via email and recorded in their internal booking dashboard.
  • TravelAndRent does not process, confirm, or guarantee payments or availability. Providers must manage all follow-up communications with the Customer directly.

5. Platform Fees

  • TravelAndRent is currently free to use for Providers.
  • However, the platform reserves the right to implement pricing or commission structures in the future. Any changes will be communicated in advance and will require the Provider’s express acceptance.

6. Provider Responsibilities

By accepting these Terms, the Provider agrees to:

  • Act professionally and respond to booking requests received through the Platform.
  • Ensure that rental products are delivered in safe, functional, and clean condition.
  • Handle all communication, logistics, delivery, returns, and payments directly with the Customer.

7. Suspension and Account Removal

TravelAndRent reserves the right to suspend or permanently remove a Provider’s account in the following cases:

  • Repeated publication of false or misleading content.
  • Use of offensive or inappropriate language or images.
  • Creation of multiple accounts without authorization.
  • Violation of these Terms or applicable laws.

8. Support

TravelAndRent provides support only to Providers, regarding:

  • Access to the platform.
  • Management of their profile and listings.
  • Technical issues within the dashboard.

The platform does not offer support to Customers.

9. Liability Disclaimer

TravelAndRent is not responsible for:

  • The accuracy, legality, or reliability of the information provided by Providers.
  • The actual condition, safety, or availability of the rental products.
  • Payments, cancellations, no-shows, or incidents during the rental period.
  • Any damages, injuries, or losses related to the rental service.

Each Provider is fully and solely responsible for the service they offer.

10. Intellectual Property

The design, layout, code, and branding of the platform are the exclusive property of TravelAndRent (Pacific Board S.L.).

Content uploaded by Providers remains their own, but TravelAndRent may use such content for promotional or informational purposes.

11. Updates and Acceptance of Terms

TravelAndRent reserves the right to update or modify these Provider Terms and Conditions at any time, for reasons including but not limited to changes in the platform's features, pricing model, or applicable regulations.

Any changes will be notified to the Provider through email, the Provider dashboard, or any other effective communication channel.

To continue using the platform, the Provider must expressly accept the updated Terms. If the Provider does not accept the new version within the indicated timeframe, TravelAndRent reserves the right to suspend or permanently remove the Provider’s account and listings from the platform.

12. Governing Law and Jurisdiction

These Terms shall be governed by the laws of Spain. Any dispute shall be submitted to the Courts of Barcelona, unless mandatory consumer law dictates otherwise.
